Terms of Service

1. Overview

These Terms of Service (“Terms”) govern your use of the oneBot platform, operated by Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur (ZVR-Zahl: 1151789182), a registered association (Verein) under Austrian law, with address at Canavalstraße 7/143, 5020 Salzburg, Österreich.

By accessing or using oneBot — including browsing this website, creating an account, or interacting with any oneBot service — you agree to be bound by these Terms and acknowledge that you have read and understood our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms or the Privacy Policy, please do not use the platform.

2. The Service

oneBot is an AI-powered personal and business assistant platform. It connects to third-party services, executes tasks, and communicates on your behalf based on your instructions and configuration.

By default, oneBot uses OpenRouter as its AI routing layer to connect to 100+ large language models (LLMs) from providers including Anthropic, OpenAI, Google, Meta (Llama), Mistral, Qwen (Alibaba), DeepSeek, xAI (Grok), MiniMax, NVIDIA, Cohere, and others. The model landscape evolves rapidly; the current list of available models is always visible in your settings. The specific model used depends on your configuration.

Optionally, you may provide your own API keys for supported AI providers. In this case, your requests are sent directly to that provider without routing through OpenRouter. You are responsible for any costs, usage, and compliance obligations associated with your own API keys. Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur does not store your API keys beyond what is technically required to process your requests.

3. Your Data

We take your privacy seriously. Here’s what you should know:

• All your data is stored on Hetzner servers in the EU, encrypted at rest and in transit
• Your bot messages are routed through OpenRouter to the AI model you select — these providers do not train on your data when accessed via API
• We never sell, rent, or misuse your data
• We never see your payment credentials (card numbers, bank details) — only transaction amounts for billing purposes
• We collect analytics and usage statistics to improve the platform, but we never use your data for advertising or profiling
• We do not use your personal data, conversations, or bot interactions to train, fine-tune, or improve any AI or machine learning model — neither our own nor any third party’s

4. Use at Your Own Risk

• You are responsible for your bot’s configuration. This includes selecting the appropriate AI model, configuring spending limits, and granting or restricting access to third-party services and tools.
• You are solely responsible for what your bot does. oneBot provides the platform and tools, but we have no control over how you configure your bot, what instructions you give it, or what actions it takes. You bear full responsibility for all outputs and actions of your bot.
• You are responsible for reviewing and approving actions. If you grant your bot permission to act autonomously (e.g., sending emails, making purchases, managing calendar events), you accept that the bot may take actions based on its interpretation of your instructions.
• AI models are not infallible. They can misunderstand instructions, produce inaccurate information, or take unintended actions. Always verify critical information independently.
• External service access is at your discretion. If you provide your bot with access to third-party services or tools, you do so entirely at your own risk. We strongly recommend setting appropriate permissions and limits.
• We cannot control bot behavior beyond platform safeguards. While we implement safety measures, the combination of AI models, user instructions, third-party integrations, and own API key configurations creates outcomes that we cannot predict or fully control. Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur cannot be held liable for any damage caused by user-configured bots, including but not limited to financial loss, reputational damage, or data misuse.
• Prohibited use of bots is your responsibility. You must not configure or instruct your bot to perform illegal, harmful, or abusive actions. Any misuse of the platform through your bot is your sole legal responsibility.

5. Our Commitment to You

While use of the platform is at your own risk, we want you to know:

• We are always here to help. Our support team is available to assist you with configuration, troubleshooting, and any issues that arise.
• We continuously improve safety measures. We actively work to reduce the risk of unintended bot behavior through testing, monitoring, and safety layers.
• We provide tools for control. You can set a spending limit, configure approval workflows, and define permission boundaries to keep your bot in check.
• Transparency is core to our values. Every bot action is logged and auditable. You always have full visibility into what your bot does and why.
• We never misuse your data. Your data powers your bot — nothing else. We don’t sell it, we don’t profile you, and we don’t use it for anything beyond providing the service.

6. Limitation of Liability

Scope of liability: Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur shall be liable without limitation for damages arising from injury to life, body, or health caused by a negligent or intentional breach of duty by Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur, its legal representatives, or its vicarious agents. Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur shall also be liable without limitation for damages caused by intentional or grossly negligent conduct.

Cardinal obligations (wesentliche Vertragspflichten): In the event of a breach of a material contractual obligation (Kardinalpflicht) — i.e., an obligation whose fulfilment is essential for the proper performance of this contract and on whose compliance you may regularly rely — caused by simple negligence, Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur’s liability shall be limited to the foreseeable, contract-typical damage.

Exclusion of further liability: Beyond the cases described above, Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur shall not be liable for damages arising from simple negligence. In particular, Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur shall not be liable for:

• Actions taken by your bot based on your instructions or configuration
• Incorrect, incomplete, or misleading information generated by AI models
• Losses resulting from bot actions, including unintended operations or communications
• Unauthorized actions caused by misconfiguration or insufficient access restrictions
• Data loss or service interruptions caused by third-party providers (including OpenRouter and AI model providers)
• Failure to configure an appropriate spending limit or approval requirements
• Selection of an AI model that is not suitable for your use case
• Use of own API keys and any consequences arising from direct provider interactions
• Any damage, harm, or legal liability arising from how you configure, instruct, or deploy your bot

You agree that your use of oneBot is voluntary and at your own risk. We strongly recommend starting with conservative settings and gradually expanding your bot’s permissions as you gain confidence.

7. Disclaimer of Warranties (“As Is”)

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Any guarantee that the platform will be uninterrupted, error-free, or free of viruses or other harmful components
• Any guarantee that AI-generated outputs will be accurate, complete, current, or suitable for your purposes
• Any guarantee of uptime, availability, or performance of third-party AI models or services

You assume full responsibility for determining whether the service is appropriate for your use case and for all consequences of using it.

EU consumer notice: If you are a consumer in the European Union, this disclaimer does not affect any mandatory warranty rights you may have under the applicable consumer protection law of your country of habitual residence, including rights under EU Directive 2019/770 (Digital Content Directive).

8. No Professional Advice

The oneBot platform is a general-purpose AI chatbot that may provide conversational assistance, information, and task automation. All information provided is for informational and entertainment purposes only and must not be treated as a substitute for qualified professional guidance.

Specifically:

• The Companion feature (including personality modes such as “supportive listener,” “reflective conversation partner,” “personal journal companion,” or similar) is a conversational AI feature, not a professional service of any kind. It does not diagnose, treat, or provide clinical care.
• Any legal, tax, or compliance information provided by oneBot is not legal advice. Always consult a qualified attorney or tax professional.
• Any information about products, services, or topics is general information only. Always verify critical information independently and consult appropriate professionals.

You acknowledge that you use all such features at your own risk and that Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur shall have no liability for any decisions, actions, or consequences arising from your reliance on AI-generated information in any professional domain.

9. Security Measures

Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur implements commercially reasonable, industry-standard security measures to protect your data, including encryption technologies, access controls, and secure infrastructure. Security features described on this website and in our documentation (including references to specific encryption standards such as AES-256-GCM, TLS, and similar) reflect our current best-effort practices at the time of writing.

However:

• No system is 100% secure. Despite our efforts, we cannot guarantee that our security measures will prevent every unauthorised access, data breach, or security incident.

10. AI-Generated Content & Outputs

oneBot uses artificial intelligence to generate text, suggestions, summaries, reports, and other content. You acknowledge and agree that:

• AI outputs may be inaccurate, incomplete, or misleading. Large language models can produce plausible-sounding but incorrect information (“hallucinations”). You must independently verify any critical information before relying on it.
• AI outputs are not unique or exclusive. The same or substantially similar content may be generated for other users. AI-generated outputs do not constitute original, exclusive works.
• AI outputs may not reflect current information. AI models have training data cutoffs and may not be aware of recent events, changes in law, or updated facts.
• You are responsible for how you use AI outputs. Any actions you take based on AI-generated content are your sole responsibility, including any legal, financial, reputational, or personal consequences.

11. Experimental Technology

You acknowledge that:

• oneBot is built on third-party AI models that are continuously updated by their respective providers. Model behaviour, quality, and capabilities may change at any time.
• New features, skills, and integrations may be in beta or early release and may not perform as expected.
• AI technology as a whole is an emerging field. Known and unknown limitations exist, and the technology may occasionally produce offensive, biased, or inappropriate content despite safety measures.
• Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur does not guarantee that any specific AI model will remain available, or that its performance will remain consistent over time.

12. Website Descriptions & Marketing Materials

Feature descriptions, performance statistics, use-case examples, and technical specifications presented on this website and in marketing materials are provided for illustrative and informational purposes. They represent our aspirational goals and current capabilities at the time of publication.

Specifically:

• Statistics, metrics, and performance figures shown on the website (e.g., “0 errors,” “100% precision,” “always available”) are illustrative examples or design elements, not contractual performance guarantees.
• Feature descriptions and use-case scenarios depict intended functionality. Actual results depend on your configuration, the AI model selected, third-party service availability, and other variables.
• References to specific capabilities (e.g., HR screening, financial reporting, customer support automation) describe what the platform is designed to do, not guaranteed outcomes. You remain responsible for verifying results and complying with applicable regulations in your jurisdiction.
• Nothing on this website constitutes a binding warranty, guarantee, or contractual commitment unless explicitly stated in these Terms of Service.

13. Indemnification

You agree to indemnify, defend, and hold harmless Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur, its founders, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees) arising from or related to:

• Your use of the oneBot platform in violation of these Terms
• Any content, configurations, or instructions you provide to your bot
• Actions taken by your bot on your behalf
• Your violation of any applicable law, regulation, or third-party right
• Any misuse of API keys or third-party service integrations

14. Account & Registration

You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

Age requirements:

• 18 years or older: You may create and use an account independently.
• 16 to 17 years old: You may only use oneBot with the verified consent of a parent or legal guardian who agrees to these Terms on your behalf. The parent or guardian is responsible for supervising the minor’s use of the platform and assumes all liability for it.
• Under 16 years old: You are not permitted to create an account or use oneBot in any capacity. This restriction is in accordance with GDPR Article 8 and EU Digital Services Act requirements.

Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur reserves the right to request proof of age or parental consent and to suspend or terminate accounts where age requirements are not met.

15. Acceptable Use

You agree not to use oneBot to:

• Engage in illegal activity or facilitate crimes
• Harass, abuse, threaten, or harm other individuals
• Send spam, phishing messages, or unsolicited communications
• Attempt to bypass, circumvent, or disable platform safety measures, rate limits, access restrictions, or content filters
• Impersonate another person or entity
• Use AI outputs to make fully automated high-stakes decisions affecting individuals without appropriate human oversight — including decisions related to medical treatment, financial credit, employment, or legal status
• Falsely represent AI-generated outputs as produced by a human
• Generate or distribute illegal content, including but not limited to content that is defamatory, obscene, or that violates third-party intellectual property rights
• Exploit AI companion features to manipulate, groom, or psychologically harm vulnerable individuals, including minors

Reverse Engineering & Competitive Use Restrictions: You further agree not to:

• Reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying algorithms, or architecture of the oneBot platform
• Extract, scrape, or systematically collect data from the platform through automated means (including bots, crawlers, or similar tools)
• Attempt to extract, replicate, or derive model weights, parameters, training data, or proprietary system prompts from any AI model used through the platform
• Use the platform, its outputs, or insights derived from its use to develop, train, fine-tune, or improve any AI model, product, or service that competes with oneBot or Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur
• Benchmark, evaluate, or test the platform for the purpose of building or improving a competing product without prior written consent from Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur
• Sublicense, resell, redistribute, or provide access to the platform to third parties without authorisation

16. Intellectual Property

The oneBot platform, including its design, code, branding, and content, is owned by Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur. You retain ownership of any content you create using the platform. You grant Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur a limited, non-exclusive licence to process and store your content solely to the extent necessary to provide the service.

17. Payments & Billing

oneBot uses a subscription-based pricing model with additional AI usage billed via credits. Billing is transparent and based on your plan and actual AI usage. All prices are displayed in Euros (€) and are exclusive of VAT (zzgl. MwSt.).

Payments are processed by Stripe, Inc. as our payment service provider. Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur is the seller of record and the contracting party. Upon subscription activation, dedicated server resources are immediately provisioned for your account.

AI credit top-ups are digital content delivered immediately upon purchase. AI credits do not expire.

oneBot provides a spending limit feature (not a daily limit) which allows you to set a maximum cumulative spend cap. This is a safeguard, but you remain responsible for monitoring your own usage. Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur is not liable for charges incurred before a spending limit is reached or before the limit is enforced.

We never see or store your payment credentials. We only receive confirmation of successful payments and transaction amounts for accounting.

18. Termination & Data Deletion

You may close your account at any time. Upon closure:

• Your data will be deleted within 90 days as part of our standard deletion cycle
• If you request expedited deletion, we will process it within 30 days of your explicit request
• Financial records may be retained where required by law

We may suspend or terminate your access for violations of these Terms, with or without prior notice.

19. Service Availability & Force Majeure

We aim to provide reliable service but cannot guarantee uninterrupted availability. The platform may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Third-party service outages (e.g., OpenRouter, AI model providers, Hetzner hosting)
• Events beyond our reasonable control, including natural disasters, power failures, cyberattacks, government action, or other force majeure events

Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur shall not be liable for any loss or damage arising from service unavailability due to the above circumstances.

20. Third-Party Services

oneBot integrates with various third-party services (e.g., Google, Slack, Salesforce) and AI model providers via OpenRouter. Your use of these integrations is subject to the respective third party’s terms. We are not responsible for third-party service availability or data handling beyond our control.

Google Services: When you connect Google services to oneBot (including Google Calendar, Tasks, Contacts, Drive, Docs, Sheets, Slides, Forms, and YouTube), your use of these integrations is subject to Google’s Terms of Service and the Google API Terms of Service. If you use YouTube features, you also agree to be bound by the YouTube Terms of Service. oneBot accesses Google data solely to provide the bot features you request — data is retrieved live and is not stored on our servers. 21. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Notify registered users via email at least 14 days before the changes take effect
• Update the “Last updated” date at the top of this page
• Clearly summarise what has changed in the notification

Continued use of the platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you may close your account before the effective date.

22. Governing Law

These Terms are governed by and construed in accordance with the laws of Austria.

EU consumers: If you are a consumer habitually resident in a Member State of the European Union, you additionally benefit from any mandatory provisions of the consumer protection law of your country of habitual residence. This choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of your habitual residence (Regulation (EC) No. 593/2008 — Rome I, Article 6(2)).

Nothing in these Terms restricts your right, as an EU consumer, to bring proceedings in the courts of your country of habitual residence.

23. Dispute Resolution

24. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

25. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements you enter into with Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur, constitute the entire agreement between you and Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur regarding the use of the platform and supersede all prior or contemporaneous communications, proposals, and representations with respect to the platform.

26. No Waiver

The failure of Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur.

27. Assignment

You may not assign or transfer these Terms, or any rights or obligations under these Terms, without the prior written consent of Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur. Foxx – Verein zur Förderung einer zukunftsorientierten Lebenskultur may assign these Terms without restriction, including in connection with a merger, acquisition, corporate reorganisation, or sale of all or substantially all of its assets.
